Review to Consider the Merits of Establishing a Gun Court in NSW
The NSW Attorney General has asked the Hon Gordon Samuels AC CVO QC to undertake a review to consider the merits of establishing a gun court in NSW.
The terms of reference of the review are as follows:
(1) To review the manner in which gun related crime is prosecuted and dealt with in New South Wales courts.
In particular, the review will consider:
(i) current prosecution policies and guidelines of the Director of Public Prosecutions and NSW Police with respect to the prosecution of gun related crime, and
(ii) sentencing with respect to gun related crime
(2) To consider the advantages and disadvantages of establishing an exclusive gun related jurisdiction (gun court) in New South Wales having regard to the various models in the United States.
(3) If the review considers there is merit in the creation of such an exclusive gun related jurisdiction in New South Wales the report should make recommendations concerning its objectives, the nature of its jurisdiction and its mode of operation across New South Wales.
(4) Whether or not the review sees merit in the creation of an exclusive gun related jurisdiction in New South Wales, the report should include recommendations for any necessary amendments to prosecution policies and guidelines with respect to gun related crime and any other recommendations for improving the manner in which gun related crime is prosecuted and dealt with by the courts.
